The Office of Personnel Management (OPM) issued in the Federal Register this week a proposed rule to allow the payment of Sunday premium pay only to part-time federal civilian employees.  Currently, the rule entitles payment of Sunday premium pay to full-time prevailing rate employees.  The proposed change would eliminate reference to “full-time” and clarify that “part-time employees who are regularly scheduled to work on a Sunday are entitled to Sunday premium pay for the non-overtime hours worked.”  This expansion of pay will not include “intermittent employees” due to “the nature of their work and irregular work schedule.”  This change implements the court ruling in hte case of Fathauer v. United StatesComments on this proposed rule are due back to OPM before June 8, 2010.
